Privacy and Protection of Personal Data

Intellego Yazılım Medya Bilgisayar Danışmanlık ve Ticaret Limited Şirketi (“the Company”, “we”, or “Intellego Softworks”) takes the privacy and security of your personal data seriously.
This notice explains the scope in which we process the personal data of individuals who visit our website, contact us, ask about our services or request a quote, act on behalf of a current or prospective client, or reach the Company in any other way.
Your personal data is processed and protected in line with the applicable legislation, and in particular with Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”).

Where we process personal data held in a client's own systems solely on that client's instructions, as part of the software development, integration, maintenance, consultancy, cloud, or similar technology services we provide, we act as a data processor. The terms governing processing in those cases are set out separately in the contract between that client and the Company.
2. What personal data we may process
Depending on your relationship with the Company and the services you use, the following categories may be processed:
- Identity data: name, surname, and where needed other information that identifies you.
- Contact data: email address, telephone number, company details, and postal address.
- Client and prospective client data: the company you work for, your role, the services you ask about, and project or quote details.
- Correspondence: contact forms, email threads, support requests, and the messages you send us.
- Transaction and technical data: IP address, access time, browser and device information, error logs, security logs, and similar technical records.
- Website usage data: the pages you open, what you interact with, and which features you use.
- Contract and transaction records: where a service relationship is formed, the contracts, quote process, service scope, and records of the commercial relationship.
- Anything else you send us: other information you choose to share when you contact us or use our services.
We do not ask for special categories of personal data unless the nature of the service or the transaction requires it. Please do not send special categories of personal data through the contact forms or other free-text fields unless it is necessary.
3. How we collect personal data
Your personal data may be collected by electronic or physical means through:
- our website and the contact forms on it,
- email, telephone, and other channels,
- meetings and commercial discussions,
- quote and contract processes,
- support and customer service channels,
- the digital systems the Company uses,
- web servers, security systems, and necessary cookies,
- business partners or publicly available sources, where the law permits it.
4. Why we process personal data
Depending on the transaction, your personal data may be processed in order to:
- answer the questions and requests you send us,
- give you information about our services,
- assess quote and project requests,
- manage relationships with clients and prospective clients,
- deliver software development, consultancy, support, and similar services,
- form and perform contracts,
- provide technical support and customer service,
- keep the website working, fast, and secure,
- run our information security processes,
- prevent unauthorised access, misuse, fraud, and other security risks,
- improve the quality of our systems and services,
- manage legal disputes and protect our rights,
- meet obligations arising from legislation,
- respond to lawful requests from authorised public bodies,
- carry out commercial communication and marketing where that is needed and the legal conditions are met.
We do not use your personal data for purposes incompatible with those it was collected for, or for purposes with no legal basis under the applicable legislation.
5. Legal grounds for processing
Your personal data is processed on whichever of the conditions set out in the KVKK and the related legislation applies.
Depending on the processing, those grounds are in particular:
- processing is expressly provided for by law,
- processing is directly related to forming or performing a contract,
- processing is necessary for the Company to meet its legal obligations,
- processing is necessary to establish, exercise, or protect a right,
- processing is necessary for the Company's legitimate interests, provided it does not harm your fundamental rights and freedoms.
Where processing cannot rest on any of the grounds above or on another ground set out in the legislation, and your explicit consent is required, we ask for that consent separately.
Withholding your consent, or withdrawing consent you gave earlier, does not stop processing that rests on a ground other than consent.
6. Who else sees your data
Your personal data may be shared, only so far as it is necessary and in line with the purpose of processing and the applicable legislation, with:
- authorised employees and units within the Company,
- infrastructure and hosting providers,
- email and corporate communication providers,
- information technology and cyber security providers,
- accounting, legal, and similar professional service providers,
- suppliers and business partners who help deliver our services,
- public bodies, courts, and other official authorities empowered by law.
When data is shared with a third party, we take care that the legal, administrative, and technical measures needed to protect it are in place.
7. Transfers outside Türkiye
Some of the cloud infrastructure, hosting, email, monitoring, security, communication, and similar technology services we use have servers or providers outside Türkiye.
Where a transfer abroad takes place, it is carried out in line with the KVKK provisions on transferring personal data outside Türkiye and with the secondary legislation in force, with the legal conditions and appropriate safeguards that transfer requires.
We review our providers and our transfer processes when there is reason to, and apply reasonable legal, administrative, and technical measures to protect personal data transferred abroad.
8. How long we keep data, and how it is deleted
Your personal data is not kept indefinitely. It is held for as long as the purpose of processing requires and for any mandatory retention period set by the applicable legislation.
In setting a retention period we take into account:
- the purpose the data was processed for,
- how long your relationship with us lasts,
- contractual and legal obligations,
- limitation periods for possible legal disputes,
- information security and record-keeping requirements.
When the reasons for processing fall away, the data is deleted, destroyed, or anonymised in line with the applicable legislation.
9. Security
The Company applies technical and administrative measures suited to the risks, in order to prevent personal data from being:
- processed unlawfully,
- accessed unlawfully,
- altered or shared by unauthorised people,
- lost or damaged,
and in order to maintain an appropriate level of security.
Depending on the activity, that can include access controls, authorisation policies, logging and monitoring, secure communication, encryption, backups, security updates, security testing, and staff awareness.
No transfer over the internet and no method of electronic storage is absolutely secure, and that should be borne in mind.
10. Cookies and similar technologies
Our website may use the cookies and similar technologies needed for it to work correctly and securely.
The site sets no cookies of its own in order to function. We use Google Analytics to measure visit statistics, and that service writes its own cookies. You can block them in your browser settings, and the site keeps working when you do.
If cookies for analytics, preferences, advertising, or marketing are introduced, we give separate notice about them, and where the applicable legislation requires explicit consent those technologies are not switched on until that consent is given.
11. Third-party websites and services
Our website may contain links to third-party websites or services.
The Company is not responsible for how third-party services you reach through those links process personal data. Read that third party's privacy and data protection policies before you use the service.
12. Your rights under the KVKK
Under article 11 of the KVKK, and so far as the conditions are met, you may apply to the Company to:
- learn whether your personal data is being processed,
- request information about it if it has been processed,
- learn the purpose of the processing and whether the data is used in line with that purpose,
- learn which third parties inside or outside Türkiye the data has been transferred to,
- have the data corrected if it has been processed incompletely or wrongly,
- have the data deleted or destroyed where the conditions in the legislation are met,
- have any correction, deletion, or destruction notified to the third parties the data was transferred to,
- object to a result reached against you through analysis carried out solely by automated systems,
- claim compensation if you suffer loss because your personal data was processed unlawfully.
13. How to exercise your rights
You can send us a request under the KVKK by any of the methods the legislation in force provides for.
Your application should contain:
- your name and surname,
- information that verifies your identity, appropriate to the nature of the request,
- a clear and understandable description of what you are asking for,
- the contact details you want the answer sent to,
- any information and documents that support your request.

We assess applications according to what is being asked and within the periods the legislation sets.
We may ask for further information in connection with your application, in order to verify your identity and to keep personal data from being disclosed to the wrong person.
14. Children's personal data
Our website and services are aimed at businesses and professional users, and we do not set out to collect personal data from children.
If you believe a child's personal data has reached us without a legal basis, contact us so that we can look into it and act on it.
15. Changes to this notice
We may update this privacy and personal data notice as our activities, the technologies we use, or the applicable legislation change.
The current version is always published on this page.
Where a change is significant, we may give separate notice through the website or another suitable channel, so far as the circumstances require it.
